Buyer conditions

Effective October 21, 2026

These are the conditions a buyer agrees to when completing a suppressor screening on SkipForm4.com. They may be updated, and a buyer agrees to the conditions as updated. This page always shows the current conditions.

Required: You Acknowledge and Understand The Tool’s Use

This is a preliminary, first-step check for buyers. It does not approve any sale. The seller ultimately makes all decisions. Immediately before the sale, the seller must also confirm that every legal rule and requirement is met.

Required: You Acknowledge and Understand Interstate Transport Limitations

At this time, 26 U.S.C. § 5861(j) makes it unlawful to transport, deliver, or receive in interstate commerce any NFA firearm that "has not been registered as required" by the NFA. The injunction affects NFA registration and transfer requirements for covered transactions, but it is presently unclear how the injunction impacts § 5861(j). Consult qualified counsel before any interstate movement.

Required: You Acknowledge and Understand the Transaction

I understand and acknowledge that the injunction applies only to the specified National Firearms Act (NFA) provisions and does not eliminate or modify any otherwise-applicable requirement under the Gun Control Act (GCA) or federal, state, or local law. I agree to accurately and completely execute all buyer portions of ATF Form 4473; provide valid identification and all other required documentation; submit to the applicable FBI NICS or Point-of-Contact state background check or present a valid ATF-recognized NICS-alternative permit (if applicable and seller accepted); and comply with all applicable permit, waiting-period, eligibility, residency, age, product, and other legal requirements. I understand that the seller must complete all required ATF Form 4473 and A&D record entries and must deny, delay, defer, discontinue, or otherwise decline to complete the transaction whenever required by law, directed by the applicable background-check authority, or unable to confirm my eligibility or the legality of the transaction.

The court order has limits, and all other gun laws still apply. The court order only protects certain people and sales. It is not a nationwide exemption and does not cover everyone. Living in a covered state is not enough by itself. The seller must confirm my transaction is tied to a named plaintiff or covered business, including any membership or customer relationship I claim. I promise that all ID, membership, order, and other papers I provide are real, current, complete, and correct. I understand that all other gun laws still apply. That includes ATF Form 4473, background checks (FBI NICS, a state point-of-contact check, or an ATF-accepted permit as an exemption to the background check), rules on who may own a gun, the seller's A&D records, and state and local laws. The seller must stop or refuse the sale if anything can't be confirmed or the law doesn't allow it.

This is my choice, and completing a Form 4 is still an option. I am choosing to ask for a transfer without an approved ATF Form 4. It can happen only if the seller decides, at the time of sale, that every requirement is met, the court order covers the sale, the sale is otherwise legal, and the sale is consistent with his/her business practices. I know I can say no to this option, choose not to take the suppressor, or ask the seller about the regular Form 4 process. No checklist, release, seller statement, or guidance binds the ATF, the Department of Justice (DOJ), any court, or any other government agency. Signing this does not require the seller to approve or finish the sale. The seller may require the regular Form 4 process for any reason.

The law may change, and I must not take this suppressor across state lines without legal advice. The court order and related laws may change. They could be appealed, paused, narrowed, overturned, or read differently. If a court or agency later adds a legal requirement for this suppressor, I will follow it. Federal law (26 U.S.C. § 5861(j)) covers moving an NFA item across state lines if it "has not been registered as required." It is not yet clear how the court order affects that law. I understand the advice is to keep this suppressor in the state where I buy it. This review and the sale do not give me permission to move it to another state. I must get advice from my own lawyer before I carry, ship, or receive it across state lines. I understand that without an approved Form 4, the maker may limit warranty, return, or repair service.

I accept the risks. No one is guaranteeing the result or giving me legal advice. As far as the law allows, I knowingly accept the risks of taking this suppressor without an approved ATF Form 4. These include legal, financial, and practical risks. A government agency may decide, now or later, that I or this sale was not protected. That could lead to delays, being held, the suppressor being taken (seizure or forfeiture), loss of value, investigations, agency action, lawsuits, criminal charges, and legal fees. The seller's decision reflects only its view at the time of sale. It is not ATF approval, a promise about the future, protection from enforcement, or legal advice to me. I am not using this form, the seller, or any guidance in place of my own lawyer.

I release the seller from claims and will cover certain costs. As far as the law allows, I give up any claims against the Released Parties for losses caused only by my choice to go ahead without an approved ATF Form 4. “Released Parties” means the seller and its owners, members, managers, officers, employees, agents, affiliates, successors, assigns, vendors, suppliers, lawyers and compliance advisors. This covers losses from a later change in the law, a pause or reversal of the court order, government action, a later finding that I or the sale was not protected, or my failure to follow a legal rule after the sale.

I also agree to pay for and protect the Released Parties from claims by others, including reasonable legal costs (to "indemnify and hold harmless" them), if the claims come from:

- false, forged, expired, misleading, or incomplete information or papers I provide;
- hiding facts that matter to my eligibility; or
- my illegal possession, transfer, transport, shipping, receipt, or use of the suppressor after the sale.

This private agreement does not stop the ATF, DOJ, any court, or any government agency from investigating, enforcing the law, prosecuting, taking property, or taking other legal action. If a court finds any part of this agreement can't be enforced, the rest still applies as far as the law allows. I have read and understand these terms. I had the chance to ask questions and get my own legal advice. I am signing by choice. Everything I gave on the buyer checklist is true and complete as far as I know.

No lawyer represents me here. Using this tool does not create a lawyer-client relationship, privilege, confidentiality, or duty between me and any of the seller’s service, tech, or hosting companies; e-signature or document vendors; the seller's lawyers, compliance advisors, or any counsel that the seller hires. They work for the seller, not for me. Nothing here is legal advice to me. I am responsible for getting my own legal advice.

Which state's law applies. The laws of the seller's state govern this agreement and any dispute about it or this screening, because the seller's licensed store is there. That state's rules for choosing another state's law do not apply. Any lawsuit must be filed in a state or federal court in the seller's state. This covers my agreement with the seller only. It does not take away any right my own state gives me that cannot legally be given up.

Electronic Signature. By typing my full legal name and submitting, I am signing this form electronically. My typed signature counts the same as a handwritten one.

Required: You Consent to Use Your Information for This Transaction

In short: you allow the seller and its partners to use your information in order to handle this transaction and follow the law.

By initialing, I confirm I read these conditions. I allow the seller and its Transaction Partners to collect, use, and share the information I give in this tool, and to store it until it is deleted as described below. This includes my name, contact details, address, membership details, firearm and sale details, answers, signature, and related device or technical information. They may use it only as reasonably needed to:

1. review and record the sale;
2. check whether the court order covers the sale;
3. confirm my information, membership, or other eligibility;
4. prepare sale records, forms, releases, and receipts;
5. complete, check, or defend the sale;
6. prevent fraud or misuse;
7. follow the law, including records rules, subpoenas, court orders, and government requests; and
8. tell me about the sale, the court order, appeals, new rulings, or government guidance that may affect my suppressor.

"Transaction Partners" means the seller's service, tech, and hosting companies; e-signature and document vendors; lawyers and compliance advisers; manufacturers and distributors; covered groups or membership checkers; and government or law enforcement agencies. They get my information only when reasonably needed for the reasons above, or when the law requires it.

When the seller countersigns, my details are deleted from this tool, and the printed packet the seller gives me is the only copy.

The seller and its Transaction Partners may contact me about these matters by mail, email, phone, or other contact info I give. These messages may continue even if I say no to marketing. If I withdraw this consent later, it does not undo what was already done. It may stop the seller from finishing the sale. It does not require deleting records that must or may be kept.
